1. Scope and Provider

These Terms of Service govern the use of richi.solutions, operated by Yves-Marcel Richel (sole proprietorship), Homburger Landstr. 851, 60437 Frankfurt am Main, Germany. Our services include: the website with the studio portfolio and editorial content, the contact form, and optional user accounts for individual products and funnels.

2. Use of Artificial Intelligence (EU AI Act)

Richi uses AI systems in accordance with Regulation (EU) 2024/1689 (EU AI Act).

• AI-assisted creation of content and visual assets
• Automated content and development workflows
• AI-assisted software development
• AI-assisted communication and support

Our AI systems fall into the low-risk category under the EU AI Act. No fully automated decision-making with legal or significant effects takes place (Art. 22 GDPR). AI-generated content is labeled as such per Art. 50 EU AI Act. User data is not used to train external AI models.

3. Intellectual Property

You retain ownership of content you submit through our services (e.g., messages via the contact form).

All content, designs, software, and works created by Richi remain our intellectual property and are protected by German copyright law.

4. User Obligations

Users agree to:

• Provide accurate and truthful information
• Not circumvent or abuse the website and its security mechanisms
• Use the services only for their intended purpose

5. Limitation of Liability

We provide our services to the best of our knowledge and ability. We are not liable for:

• Temporary unavailability of the website or individual services
• Errors or inaccuracies in AI-generated content
• Damages caused by misuse of the services by the user
• Content or services of third parties accessible through our website

The limitation of liability does not apply in cases of intent, gross negligence, or breach of essential contractual obligations (cardinal obligations). Liability for damages arising from injury to life, body, or health remains unaffected.

6. Third-Party Services

Our website uses services from third-party providers (Vercel for hosting, Supabase for database and authentication, Resend for email delivery). Use of these services is subject to their respective terms and privacy policies. Linked products from the portfolio have their own terms of service.

7. Applicable Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes is Frankfurt am Main, unless mandatory legal provisions require a different jurisdiction.

8. User Accounts

Account Deletion: You can request deletion of your account at any time — by email to info@richi.solutions. This action is permanent and removes all your personal data and account information.

Data Retention: After account deletion, your data will be permanently deleted within 30 days, unless legal retention requirements apply (e.g., tax data: 10 years per § 147 AO).

Account Changes: You can change your email address and password via the sign-in feature. Email changes require confirmation to the new address.

9. Changes to Terms

We may update these terms to reflect changes in our services, legal requirements (including EU AI Act), or technological developments. Material changes will be communicated on the website or via email. Continued use after the effective date constitutes acceptance.
